Aboveground Storage Tanks (AST) in West Virginia must be inspected on or before January 1st, 2015.
- This interim certification states that all tanks above 1,320 gallons, regardless of contents, must be inspected on or before January 1st, 2015. This new law comes shortly after the 2014 Elk River chemical spill which contaminated the drinking water of 300,000+ citizens. As you can see on the West Virginia Department of Environmental Protection’s website: “The West Virginia Department of Environmental Protection (WVDEP) has developed Interim Certification Forms to assist the regulated community in complying with the annual inspection and certification requirements of the Aboveground Storage Tank Act at W.Va. Code § 22-30-6.
- Every owner or operator of an aboveground storage tank subject to the Act shall have an annual inspection of each tank performed by a professional engineer registered with the WV State Board of Registration for Professional Engineers or a qualified person working under the direct supervision of a registered professional engineer, or by an individual certified to perform tank inspections by the American Petroleum Institute (API) or the Steel Tank Institute (STI).”
- It also states that every owner or operator shall submit a certification from an individual certified to perform tank inspections by the API or the STI documenting that each AST system was inspected and meets the minimum required standards established in the Act.
